reversing the pattern of cell division itself, two embryonic stem cell cases merge into one

Two separate lawsuits being brought against the Independent Citizens' Oversight Committee created last November by California's Proposition 71, passed last November by a 59%-to-41% vote, have now been consolidated into a single case.

You can listen to Life Legal Defense Foundation Executive Director and attorney for plaintiffs People's Advocate in one of these previously-separate cases talk about that case by clicking on the title of this July 12, 2005 California Politics Today article: "Alleged "special interest" attorney discusses pending litigation against California's Independent Citizens' Oversight Committee (ICOC) embryonic stem cell research group."

You can read about the originally-separate "reverse validation action" that was filed by attorney David Llewellyn on behalf of the California Family Bioethics Council in the California Politics Today article entitled "California Family Bioethics Council files "reverse validation action" to shut down Proposition 71 and all its progeny".

You can read the "tentative ruling" issued by the Alameda Superior Court in the matter of consolidating these cases on August 3, 2005, by clicking here.

Attorney Cody appeared again today on California Politics Today to talk about the consolidated case. You can listen to that interview by clicking here.

next steps along the stem cell litigation trail

A summons calling on other interested parties to get involved in the "reverse validation action" into which these cases have now been consolidated expires, according to Ms. Cody, on August 31, 2005. Sometime after that, she said, she expects Attorney General Bill Lockyer to file a motion for a summary judgment to dismiss the consolidated case on its merits.

According to Ms. Cody, that motion will not be heard before the September 15, 2005, case management conference now scheduled to allow both sides and the court to arrange a timetable for consideration of the consolidated case.

why this case matters even before it's decided
