California State Senator Joe Simitian (D-Palo Alto) proposes a three-year moratorium on the deployment of RFID-equipped smart cards as California driver's licenses

Joe Simitian represents Palo Alto and environs in the California State Senate.

He's the author of SB 768 (formerly SB 682), which proposes to criminalize "skimming" of personal data from RFID-enabled smart cards; implement provisions to insure the security of such cards when issued by the State of California; and impose a three-year moratorium on the issuance of such cards on a mass basis by the State of California, for example, in the case of state driver's licenses.

He last appeared on California Politics Today on August 3, 2005, in an audio-debate with AeA/High-Tech Trust Coalition spokesperson Roxanne Gould, entitled "California State Senator Joe Simitian (D-Palo Alto) and AeA/High-Tech Trust Coalition spokesperson Roxanne Gould discuss SB 682."

He appeared again today on California Politics Today to talk about the transformation of SB 682 into SB 768, and the circumstances surrounding that transformation.


SB 682 dies in the Assembly Appropriations Committee

According to an article by Mark Gladstone, a San Jose Mercury reporter working out of their Sacramento bureau, published on August 26, 2005, and entitled "Setback for law on RFID limits--TECH BATTLES CONCERNS OVER PUBLIC AGENCY USE:

"SACRAMENTO - In the face of fierce opposition from high-tech companies, landmark state legislation to limit public agencies from using radio frequency devices was dealt a major setback Thursday.

"The Assembly Appropriations Committee, without discussion, shelved the measure for the year, though Sen. Joe Simitian, who has been pushing the proposal, vowed to try to revive it before the Legislature adjourns for the year on Sept. 9."

During today's interview, which you can access by clicking here, State Senator Simitian explained how SB 682 was put on the "suspense" calendar in the California Assembly's Appropriations Committee and subsequently failed to pass out of that committee to the Assembly floor for a final vote to pass it, after enjoying considerable success in the California Senate, as well as in the Assembly Judiciary Committee.

SB 768, identical except in name to SB 682, is resurrected for consideration on the Assembly floor in 2006

Through some fast-and-fancy legislative footwork, however, this very same bill, the "Identity Information Protection Act of 2005," has been re-incarnated as SB 768, a bill currently on the "inactive" list but now eligible for consideration on the floor of the State Assembly, where it can be taken up for a final vote of passage when the California Legislature returns to Sacramento for the 2006 legislative term, without having to re-pass either the State Senate or the Assembly Judiciary Committee, and without having to spend any more time on the Appropriations Committee's "suspense" calendar where it finally ran out of steam this term.
